In order to be certified by a judge, a class action lawsuit has to meet certain criteria. For example, there needs to a substantial number of people represented in the class, and the legal questions posed must be shared by those represented. In addition, the claims of the named plaintiffs in the case must fairly represent the rest of the members in the class, and the attorneys in the class action must be experienced enough to see a class action lawsuit through to the end of the legal process.
As an example, let’s say that the XYZ Company made repeated sales robocalls to Ms. Jones’ cell phone, even though Ms. Jones never gave the company permission to call and even after she told the agency to stop calling. Ms. Jones wants to sue the XYZ Company for violations of the Telephone Consumer Protection Act. When the attorney investigates, it becomes clear from the company’s records that at least 1,000 other consumers were also repeatedly called without their consent.
Because all of the consumers were harmed in a way similar to Ms. Jones and the same legal question pertains to all consumers, it may make sense to bring a class action lawsuit against XYZ Company. Ms. Jones is the class representative, which means that, should she win her case, every other person identified as being harmed in the same way wins as well.
